Acceptable content rules

1. General provisions

1.1. These Acceptable Content Rules (hereinafter — the Rules) of OÜ "ShockLabs" (registration code 14015152) govern how Users may publish information and materials on the GPTunneL Platform (hereinafter — the Platform).

1.2. These Rules form an integral part of the User Agreement and of the other documents governing the use of the Platform.

1.3. By publishing any content on the Platform, the User confirms that they have read these Rules, understand them and undertake to comply with them.

1.4. For the purposes of these Rules, content means any data (including personal data), text, software, databases, music, sounds, photographs, graphics, video, messages and other materials.

1.5. The User is responsible for ensuring that the content they publish complies with applicable law and these Rules, and for respecting the rights and legitimate interests of third parties.

1.6. OÜ "ShockLabs" is not obliged to review content published by Users, but may review it at its own discretion, including by automated means, and may restrict, reject, hide or delete content where there are grounds to believe that it violates the law, these Rules or the rights of third parties.

2. Acceptable content

The User may publish on the Platform only content that:

● complies with applicable law;

● does not violate the rights and legitimate interests of third parties;

● does not contain prohibited, misleading, offensive or otherwise unacceptable information.

3. Prohibited content

The User must not publish on the Platform content that violates applicable law or the rights and legitimate interests of third parties, including content that:

● calls for unlawful acts;

● promotes or justifies violence, cruelty, terrorism or extremist activity;

● contains materials whose distribution is prohibited or restricted by law;

● is aimed at inciting hatred or hostility (including on national, racial or religious grounds) or at degrading the dignity of a person or a group of people;

● contains pornographic or sexual content;

● contains content aimed at violating the rights and interests of minors;

● relates to unlawful acts, goods or services;

● contains threats, insults, harassment or profanity in an unacceptable form;

● infringes copyright, related rights, patent rights, exclusive rights or other intellectual property rights;

● contains personal data published otherwise than in the manner prescribed by applicable law;

● violates a person's right to their own image, including a photorealistic likeness or voice, without their consent, in particular where this may mislead as to authenticity, identity or authority;

● contains information damaging to a person's honour, dignity or business reputation;

● contains defamation, false accusations or misleading information;

● provides specialised advice that requires professional qualifications — such as legal, financial, medical or similar advice — without the involvement of an appropriately qualified specialist;

● is aimed at creating spam, bulk mailings or intrusive advertising;

● shows signs of fraud, phishing, deception or abuse of trust;

● includes viruses, malware, scripts or code capable of disrupting the Platform, users' devices or data security;

● contains links to resources distributing malware, prohibited content or other dangerous materials;

● contains any other content that violates applicable law or promotes activity that is unlawful.

4. User obligations when publishing content

The User undertakes to:

4.1. Not violate the rights of third parties or the requirements of applicable law.

4.2. Not publish content in order to cause harm to other users, third parties or OÜ "ShockLabs".

4.3. Provide, at the request of OÜ "ShockLabs" and where there are grounds for such a request, documents, information or explanations confirming that the content was published lawfully.

5. Rights of OÜ "ShockLabs"

OÜ "ShockLabs" may:

5.1. Review content for compliance with these Rules and with the law.

5.2. Reject, hide, restrict or delete content without prior notice to the User if it violates these Rules or the law.

5.3. Restrict the User's access to individual Platform features or block the account if violations are identified.

5.4. Request explanations and supporting documents from the User in respect of published content.

5.5. Disclose information about the User and the content they have published to the competent authorities in the cases provided for by applicable law.

6. User liability

6.1. The User bears full responsibility for the content they publish — for its substance, lawfulness and accuracy, and for the consequences of publishing it.

6.2. If any claims, demands, lawsuits or orders relating to the User's content are brought against OÜ "ShockLabs", the User undertakes to settle such demands independently and at their own expense, and to compensate OÜ "ShockLabs" for the losses incurred where there are lawful grounds for doing so.

6.3. Deleting content or restricting access to it does not release the User from liability for the violations committed.

6.4. Where the User attempts to have prohibited content generated through the Platform, a response to the corresponding request may not be produced.

6.5. From the third identified attempt to generate prohibited content through the Platform onwards, the funds charged for processing the corresponding request may not be refunded, as a measure of liability (penalty) for violating the Rules.

7. How to submit enquiries

7.1. All enquiries relating to these Rules must be sent to it@shds.io.

7.2. OÜ "ShockLabs" may request additional documents and information needed to consider an enquiry.

8. Final provisions

8.1. These Rules may be amended by OÜ "ShockLabs" unilaterally.

8.2. A new version of the Rules takes effect once it is published, unless the version itself states otherwise.

8.3. Continued use of the Platform after amendments have been made constitutes the User's acceptance of the new version of the Rules.
